Abstract

ملخص: تهدف الدراسة إلى معالجة موضوع مجلس الدولة الجزائري،والذي يعتبر اعلى هيئة في نظام القضاء الإداري لضمان توحيد الاجتهاد القضائي عبر البلاد و السهر على احترام القانون.و قد حدد القانون العضوي 98-01 الاختصاصات القضائية لمجلس الدولة بالإضافة الى اختصاصاته الاستشارية ،باعتباره جهة استئناف للفصل في القرارات ابتدائيا عن الجهات القضائية العادية ، وباعتباره جهة نقض للفصل في القرارات الصادرة نهائيا عن الجهات القضائية الادارية. L'étude vise à aborder la question du Conseil d'Etat algérien, Ce qui est considéré comme le corps le plus élevé dans le système de justice administrative; Pour assurer l'uniformité de la jurisprudence dans tout le pays et pour assurer le respect de la loi, la Loi organique 98-01 définit la compétence du Conseil d'État ainsi que ses pouvoirs consultatifs. En tant qu'organe d'appel pour statuer initialement sur les décisions des organes judiciaires ordinaires, Et comme un point de disqualification dans les décisions rendues par les autorités judiciaires administratives. Abstract : The study aims at addressing the issue of the Algerian State Council, Which is considered the highest body in Administrative justice system; To ensure uniformity of jurisprudence across the country and to ensure respect for the law, The Organic Law 98-01 defines the jurisdiction of the Council of State as well as its advisory powers , As an appellate body to adjudicate decisions initially from ordinary judicial bodies, And as a point of disqualification in decisions issued by the administrative judicial authorities
