Abstract

Abstract : Legal translation differs from other types of translation in two essential points : the legal system and the term related to it . the meaning of the legal term and understanding as well as translation depend on the definition of its position inthe legal system to which it belongs . It is subject to the same in the legal system of the traget language .It is therefore the translator of legal texts to use in addition to its « language and translation » ability to compare legal systéms . we will try through this research to explain the difficulty of translating legal religious terms , Islam is itself a legal system by defining technical and difficulties associated with this type of translation ملخص: تختلف الترجمة القانونية عن غيرها من أنواع الترجمة في أمرين أساسيين : النظام القانوني و المصطلح المرتبط بذلك النظام . ويرتبط حد المصطلح القانوني و فهمه، و بالتالي ترجمته إلى لغة أخرى بفهم موضعه في النظام القانوني الذي ينتمي إليه ذلك المصطلح ، وبما يقابله في النظام القانوني للغة الأخرى . وهذا يعني أنه ينبغي على مترجم النصوص القانونية . أن يضيف إلى مهاراته اللغوية و الترجمية مهارة المقارنة بين الأنظمة القانونية . وسنحاول في هذا البحث عرض صعوبة ترجمة المصطلحات القانونية ذات البعد الديني ، لكون الدين الإسلامي نظام قانونيا في حد ذاته، وذلك بشرح التقنيات و الصعوبات المتعلقة بهذا النوع من الترجمة
