الملخص: يرتكب الصيدلي كغيره من المهنيين أخطاء تقوم على أساسها المسؤولية المدنية سواء العقدية أو التقصيرية، فقد تصدر من الصيدلي أخطاء لسوء تنفيذه للوصفة الطبية أو بيعه للدواء. بالإضافة إلى ذلك يتحمل الصيدلي المسؤولية التي تشمل أخطائه الشخصية التي يرتكبها أثناء بيعه الدواء أو أثناء إعداده و تجهيزه في صيدليته بناء على وصفة طبية، بل تمتد هذه المسؤولية لتشمل الأخطاء الصادرة من مساعديه و هي مسؤولية المتبوع و التابع. يترتب عن قيام مسؤولية الصيدلي إلتزام بتعويض المضرور عن ما لحق به من ضرر، و ذلك حسب طبيعة الإلتزام الذي أخل به.
