Abstract

ملخص المسؤولية المدنية الطبية صورة من صور المسؤولية المدنية بوجه عام، لكنها تتمتع بخصوصيات تميزها عن غيرها من المسؤوليات، تبرز من خلال الأهمية التي تحظى بها هده المهنة في إطار ممارسة الطبيب لها بكل حرية و اطمئنان وثقة مع مراعاة حياة الإنسان وسلامته الجسدية التي اعتبرت من النظام العام .فلقد تناولنا طبيعة المسؤولية المدنية للطبيب في علاقته مع المريض مع التطرق لأركان هده المسؤولية ،و أخد الخطأ الطبي حصة الأسد من هده الدراسة بتبيان مختلف صوره و كذا عملية إثباته في شقيها المتمثلين في على من يقع عليه عبء الإثبات، و كذا الوسائل القانونية المستعملة في هذا الإثبات. Résumé La responsabilité médicale est une forme de responsabilité civile en général, mais elle se distingue par l’importance de cette profession dans le médecin la pratique librement, en toute sécurité et en toute confiance, en tenant compte de la vie et de l’intégrité physique de l’être humain. Nous avons évoqué La nature de la responsabilité civile du médecin dans sa relation avec le patient, et ses différents piliers. L'erreur médicale a pris la part du lion de cette étude en montrant ces différentes formes et en la prouvant à ses deux formes, à qui incombent la charge de la preuve et les moyens juridiques utilisés. Abstract Medical responsibility is a form of civil responsibility in general, but it is distinguished by the importance of this profession in the doctor's practice freely, safely and confidently, taking into account the life and physical integrity of human being. We discussed the nature of the physician's civil liability in his relationship with the patient, and its various pillars. Medical error has taken the lion's share of this study by showing these different forms and proving it to his two forms, who bear the burden of proof and the legal means used.
