Abstract

شغلت المسؤولية الإدارية حيزا واسعا في ميدان الصحة و ذلك من خلال اشتراط ركن الخطأ الطبي و توفر شروط أخرى كأساس لقيام المسؤولية في المرفق الطبي و كذلك التعويض الذي يكون معتمدا على الضرر المرتكب لأنه لابد من وقوع علاقة مباشرة بين الضرر و الخطـأ و يبقى القاضي الإداري هو المختص في تقدير جسامة الخطأ الطبي فالمريض ألحق باللجوء إلى القضاء للمطالبة بالتعويض عن الضرر الذي أصابه جراء مرفق المستشفى.

Résumé :(Français) La responsabilité administrative a pris de l'ampleur dans le domaine de la santé en raison de l'exigence d'erreur médicale et d'autres conditions qui fondent la responsabilité dans l'établissement médical, ainsi que l'indemnisation du préjudice causé en raison du lien direct qui existe entre la lésion injustifiée et le juge administratif. En évaluant l’ampleur de l’erreur médicale, le patient a le droit de recourir à la justice pour réclamer une indemnisation du dommage causé par l’hôpital. Résumé :(Anglais) Administrative responsibility has taken on a wide scope in the field of health through the requirement of medical error and other conditions as a basis for liability in the medical facility as well as for compensation based on the damage caused because there is a direct relationship between the wrong injury and the administrative judge remains In assessing the magnitude of the medical error, the patient is entitled to resort to the judiciary to claim compensation for the damage caused by the hospital facility.
