Abstract

الملخص: يتحمل المورد الإلكتروني المسؤولية المدنية والجزائية عند إخلاله بأحد الالتزامات المفروضة عليه باعتباره رجل محترف الذي له خبرة كافية وصاحب المركز الاقتصادي مقارنة مع المستهلك الإلكتروني الذي يعد الحلقة الأضعف في تلك العلاقة التي تصاحب عرض السلعة عن طريق شبكة الانترنت وهذا ما جعله يتأثر في توجيهه لذا صدرت الآليات والضمانات لحماية حقوقه. Résumé : Le fournisseur électronique porte la responsabilité civile et pénale lorsqu’il enfreint l’une des obligations qui lui sont imposées car il est un homme professionnel qui a de l’expérience et le propriétaire de la position économique rapport au consommateur électronique, qui est le maillon le plus faible de cette relation qui accompagne l’offre de la marchandise via internet. C’est ce qui l’affecté dans sa direction par conséquent. Des mécanismes et des garanties ont été émis pour le protéger et garantir ses droits à traves.
