Abstract

ملخص: يعدّ كتمان السرّ المهني من أخلاقيات أيّ مهنة والتي تقتضيها مبادئ الشّرق والأمانة ويحميها القانون حفاظا على المصلحة العامّة والخاصّة على السواء، فالموظف العمومي ملزم باحترام هذه المسؤولية الواقعة على عاتقه ويكون ذلك تحت طائلة العقاب سواء تأديبي أو جزائي وكذا مدني. وعلى العموم فإن فعالية احترام هذا المبدأ يكون مرهون بقدرة العاملين بالمرفق العام وذلك بمختلف رتبهم ومواقعهم Résumé: La confidentialité de l’éthique professionnelle de toute profession, requise par les principes d’honneur et d’honnêteté et protégée par la loi afin de préserver l’intérêt publique et privé, l’agent publique est tenu de respecter cette responsabilité incombé à lui et en générale, l’efficacité du respect de ce principe dépend de la capacité des employés de la fonction publique et que différents rangs et positions. Summary: The confidentiality of professional ethics of any profession, which is required by the principles of honor and honesty and protected by law in order to preserve the public and private interest alike, the public official is obliged to respect this responsibility lies with him and in general, the effectiveness of the employees of the public service and that different ranks and positions.
