عرف العالم المعاصر تقدما هائلا في مجال التقنيات المرتبطة بالتطورات والاستكشافات البيولوجيا والطبية مكنت الجنس البشري من معالجة أغلب مشكلاته اليومية، وإيجاد حلول متطورة لها لأن هذه التطورات البيولوجيا والتقنية قد أثرت في المسائل الأسرية، فقد أخذ القانون الجزائري نصيبا من شرعنا الحنيف وساير الفقه الإسلامي حيث لم تكن لهذه المستجدات الطبية فقط ضوابط شرعية بل كانت تضبطها أيضا في حل مشكلة العقم لدى الزوجين فقد أجازته الشريعة الإسلامية بضوابط شرعية كما أجازتها مجموعة من القوانين في الدول الغربية والعربية من بينها الجزائر حيث عمد المشرع الجزائري إلى تقييدها بشروط قانونية تمنحها صفة المشروعية. Actuellement, le monde a vécu un grand développement technique en relation avec les progrès biologiques et médicaux. Ces créations ont permis à l'Homme de résoudre tous ses problèmes. Ces développements ont eu des répercussions sur les prises familiales. L'Algérie avait une part importante dans ces développements médicaux.
