السلطات القانونية الممنوحة للمصلحة المتعاقدة أثناء تنفيذ الصفقة العمومية

Abstract

الملخص: وفقا لمقتضيات التشريعات والتنظيمات القانونية المستجدة في مجال الصفقات العمومية، منج المشرع للمصلحة المتعاقدة عدة سلطات قانونية في مرحلة تنفيذ الصفقة العمومية، فالإدارة بصفتها طرف متعاقد فهي تتمتع بمجموعة من الامتيازات طبقا للمبادئ العامة سواء تعلق الأمر بسلطتها في الرقابة والإشراف، أو تعديل الصفقات العمومية، وتوقيع الجزاءات أثناء تنفيذها وهذا حرصا على تحقيق المصلحة العامة وسيرورة المرفق العام بانتظام.

Conformément aux exigences de la nouvelle législation et réglementions légale en matière de marchés publics, l’organisateur accorde au pouvoir adjudicateur plusieurs pouvoirs juridiques au stade de l’exécution du marché public. L’administration, en tant que partie contractante bénéficie d’un ensemble de privilèges. Conformément aux principes généraux, qu’il s’agisse de son pouvoir de surveiller, de superviser ou de modifier les marchés publics et d’imposer des sanctions lors de leur exécution, ceci afin de réaliser l’intérêt public et d’assurer le fonctionnement régulier de l’établissement public. Abstract : In accordance with the requirements of the new legislation and legal regulations in the field of public procurement, the organizer grants the contracting authority several legal powers at the stage of implementing the public procurement. The administration, as a contracting party, enjoys a set of privileges in accordance with general principles, whether it is related to its authority to monitor and supervise or amend public procurement and impose penalties during their implementation. This is in order to achieve the public interest and ensure the regular functioning of the public facility.
