حماية الشهود في القانون الجزائري

Abstract

ملخص إن القانون الجزائري قد فرض على الشاهد بعض الواجبات يتمثل في الالتزام بالحضـــــــــــــــور و حلـــــــف اليمين وأداء الشهادة، كما أقر القانون الجزائري ضمانات لحماية الشاهد للإدلاء بشهادته خلال مرحلة التحقيق الابتدائي ومرحلة المحاكمة يتمثل في سرية التحقيق الابتدائي و الاستعانة بمترجم لترجمة أقوال الشاهد و تصدي المحكمة للاعتداء على الشاهد كجريمة من جرائم الجلسات كما يحصر القانون الجزائري اتخاذ هذه التدابير في أن تكون الشهادة في قضايا الجريمة المنظمة أو الإرهاب أو الفساد كما قسم القانون الجزائري تدابير حماية الشاهد إلى تدابير غير إجرائية و تدابير إجرائية.
