عقد الامتياز في القانون الجزائري

Abstract

ملخــص : الامتياز هو احد أشكال إدارة المرافق العامة المعتمدة في القانون المقارن التي تلجأ إليها السلطات العمومية كلما تبين، في ظروف مالية أو اقتصادية أو فنية، أنها الاسلوب المناسب والمثالي لإدارة هذه المرافق. يتمثل الامتياز في مساهمة أحد أشخاص القانون الخاص، سواء أكان شخصا طبيعيا أم معنويا بإدارة مرفق تحت إشراف ورقابة مانحة الامتياز. وفي ظل المعطيات الجزائرية الحالية المتمثلة في البحث عن السبل البديلة للتسيير الموجه والإداري للاقتصاد الوطني، يمكن أن تشكل عقود الامتياز إحدى الوسائل للخصخصة الجزئية للاقتصاد الوطني، ومن بين السبل للانتقال من مرحلة سيادة القطاع العام إلى مرحلة إشراك القطاع الخاص في تحقيق النمو. Résumé : Le franchisage est l’une des formes de gestion des services publics adoptées dans le droit comparé utilisé par les autorités publiques chaque fois que, dans des circonstances financières, économiques ou techniques, il s’avère être le moyen approprié et idéal de gérer ces installations. La concession est la contribution d’une personne de droit privé, qu’elle soit physique ou morale, à la gestion d’une entité sous la supervision et le contrôle du concédant. Au vu de la recherche actuelle par l'Algérie de moyens alternatifs de gestion de l'économie nationale, les contrats de franchise peuvent constituer un moyen de privatiser partiellement l'économie nationale et l'un des moyens de passer de la souveraineté du secteur public à la participation du secteur privé.

Summary : Franchising is one of the forms of public utility management adopted in the comparative law used by public authorities whenever, in financial, economic or technical circumstances, it is found to be the appropriate and ideal way of managing such facilities The concession is the contribution of a private law person, whether natural or juridical, to the management of an entity under the supervision and control of the grantor In view of Algeria's current search for alternative ways of directing the management of the national economy, franchising contracts can be one way of partial privatization of the national economy, and one of the ways to move from public sector sovereignty to private sector involvement in growth.
