النظام القانوني لتفويض المرفق العام

Abstract

ملخص: يشكّل تفويض المرفق العام إطارا قانونيا للعقود التي تهدف إلى تحقيق المرفق العام بنقل مسؤولية تسييره للغير بأسلوب جديد وواضح يفتح المجال للاستثمار في المرافق العامة، بغرض تنمية إمكانياتها وتحقيقها للإنتاجية والمردودية المرجوة، وذلك من خلال إشراك الخواص في تسيير المرافق العامة مع إخضاعهم إلى نظام قانوني غير مألوف بشكل يضمن مقتضيات المرفق العام، كاستمرارية الخدمة العمومية وتقديمها من طرف المفوض له وفقا لمبدأ التكيف المستمر مع التطورات الراهنة وضمانا للجودة والنوعية للخدمة العامة المقدمة للمنتفعين. وقد خصه المنظم الجزائري بعدة أحكام لاسيما فيما يتعلق بإبرامه وتنفيذه، وهو محور دراستنا هذه. Résumé: La délégation des services publics constitue le cadre juridique des contrats visant à la réalisation du service public, par le transfert de la responsabilité de sa gestion à un tiers via un système nouveau et claire qui ouvre la voie à l’investissement dans les services publics, en vue de développer ses potentiel et par conséquence réaliser la productivité et la performance souhaiter, en associant le secteur privé dans leur gestion tout en le soumettant à un régime juridique exorbitant, de manière à ce que les exigences du service public soient garanties, telles que la continuité du service et la soumission des prestations offertes par le délégataire au principe d’adaptation constante aux évolutions actuelles, et d’assurer la qualité du service fournie aux bénéficiaires. L’organisateur algérien a pris plusieurs dispositions, notamment en ce qui concerne sa conclusion et sa mise en œuvre, qui fait l’objet de notre étude. Abstract: The delegation of the public facility constitutes a legal framework for contracts aimed at achieving the public Facility, by transferring responsibility for its management to others in a new and clear manner that opens up investment in public utilities, in order to develop their potential and achieving the desired productivity and profitability. This is through the involvement of private sector in the management of public utilities, while Subjecting them to an exorbitant legal regime so that the requirements of the public service are guaranteed, such as the continuity of public service offered by the delegate in accordance with the principle of continuous adaptation to current developments, and to ensure the quality of the public service provided to the public beneficiaries. The Algerian organizer has made several provisions, particularly with regard to its conclusion and implementation, which is the focus of our study.
