الحقوق والواجبات الناشئة عن عقد الزواج في القانون الاسرة الجزائري

Abstract

الملخص : لقد ظهر الزواج منذ أن ظهرت البشرية إلا أنه لم يكن منظما ولكن مع مرور الوقت والديانات بدأت العلاقة الزوجية تنظم وهذا بوضع قوانين وتشريعات دينية تنظم الزواج حيث هدفها بناء حياة زوجية على الدوام والاستقرار وحسن المعاملة بين الزوجين وتوفير أسباب الراحة والهدوء داخل الأسرة وكل هذه التنظيمات جاءت من أجل تبيين حقوق وواجبات كل من الزوجة والزوج والاسرة إلا أن جاءت الشريعة الاسلامية وساوت بين الرجل والمرأة من حيث الحقوق والواجبات وهذا من أجل علاقة زوجية أساسها المودة والرحمة ونفس الأمر بالنسبة للمشرع الجزائري من خلال مواده المذكورة في القانون أعطى لكل منهما حق وواجب هو ملزم بالقيام به اتجاه الفرق الآخر حيث نص المشرع الجزائري الأسرة الجزائرية وهي ثلاث أقسام حقوق وواجبات مشتركة، فأساس الزواج هو تكوين أسرة علاقتها المودة والرحمة والتعاون وإحصان الزوجين، والمحافظة على الانساب.

Résumé Le mariage est apparu depuis l’émergence de l’humanité, mais il n’était pas organisé mais, au fil du temps, les relations maritales ont été réglées par l’élaboration de lois et de lois religieuses régissant le mariage.
