آليات حماية الطّفل في خطر في ظل قانون 15 -12

Abstract

الملخص: يعتبر موضوع حقوق الطفل من أهم القضايا المتداولة على الصعيدين الدولي والوطني, إذ أصبحت حماية حقوق هذه الفئة هدفا تسعى إلى تحقيقه كل الدول, وهذا ما أدى إلى تطوير حماية الطفل على المستوى الوطني, حيث أولى المشرع الجزائري عن طريق نظامه الجزائي حماية واسعة للطفل بصفة عامة, وذلك بتشريع نصوص قانونية موضوعية وإجرائية تكفل الحماية للطفل وتصونه. وبناءا على أن الطفل هو الأرضية الصلبة التي تبنى عليها الأمم وتزدهر, فقد استحدث المشرع الجزائري قانونا خاصا بحماية الطفل سنة 2015 وهو القانون رقم 15-12, والذي جاء بتوحيد تشريع متخصص في حماية الطفل, حيث استهدف من خلاله تحديد آليات وتدابير لحماية الطفل من الخطر, حيث تضمن هذا القانون نوعين من الحماية.

Résumé: La question des droits de l’enfant est l’une des questions les plus importantes qui circulent aux niveaux international et national, car la protection des droits de ce groupe est devenue un objectif recherché par tous les pays, ce qui a conduit au développement de la protection de l’enfance au niveau national, où le législateur algérien à travers son système pénal a accordé une large protection aux enfants en général, en légiférant des dispositions juridiques objectives et procédurales pour assurer la protection et la préservation de l’enfant. Partant du fait que les enfants sont la base solide sur laquelle les nations sont construites et prospères, la législature algérienne a introduit en 2015 une loi sur la protection de l’enfance, la loi 15-12, qui a distingué la législation spécialisée dans la protection de l’enfance, visant à identifier des mécanismes et des mesures pour protéger les enfants du danger, qui comprenait deux types de protection.

Summary: The issue of children's rights is one of the most important issues circulating at the international and national levels, as the protection of the rights of this group has become a goal sought by all countries, and this has led to the development of child protection at the national level, where the Algerian legislator through his penal system has given broad protection to children in general, by legislating objective and procedural legal provisions to ensure the protection and preservation of the child. Based on the fact that children are the solid ground on which nations are built and flourished, the Algerian legislature introduced a child protection law in 2015, Law 15-12, which singled out legislation specializing in child protection, aimed at identifying mechanisms and measures to protect children from danger, which included two types of protection.
