دور توحيد الاجتهاد القضائي العقاري في تحقيق الأمن القضائي

Abstract

الملخص: رغم عجز القانون في أحيان كثيرة من معالجة العديد من النقاط القانونية على أرض الواقع إلا أن ذلك لا يعفي تماما عجز القاضي ، فالقاضي الإداري تخطى تطبيق القانون فقط ، هذا الأمر الذي منعه من التوفيق بين خاصية الإستقرار و الإستمرار ، بل عمد من خلال ممارسة الإجتهاد القضائي لإبتكار الحلول و المساهمة في إنشاء قواعد قانونية جديدة ، دفعا لكل خلل يشوب ميزان العدال ة بين المتقاضين ، و سعيا لإرساء و توطيد الأمن القضائي ، فالإجتهاد القضائي يؤمن للقانون مواكبة تطورات المجتمع و التكيف معها من خلال تطبيق نصوص قديمة لكن بروح جديدة و هو ما تقتضيه دول ة القانون ، و لعل توحيد الإجتهاد القضائي العقاري و دوره في تحقيق الأمن القضائي من اهم مضامين و مواضيع الإجتهاد القضائي و الأمن القضائي ككل ، وهي معاني أصبحت تتداول من الحقل القانوني عل ى نطاق واسع اليوم .

Résumé : Malgré l'incapacité de la loi dans de nombreux cas à traiter de nombreux points de droit sur le terrain, cela n'excuse pas complètement l'incapacité du juge à innover dans les solutions et à contribuer à l'établissement de nouvelles règles juridiques, afin de repousser tout déséquilibre qui fausse l'équilibre. justice entre les justiciables, et dans un effort d'établir et de consolider la sécurité judiciaire.L'État de droit, et peut-être l'unification de la jurisprudence immobilière et son rôle dans la réalisation de la sécurité judiciaire, est l'un des contenus et thèmes les plus importants de la jurisprudence et de la sécurité judiciaire dans son ensemble, des significations devenues largement diffusées dans le domaine juridique aujourd'hui.

Abstract: Despite the inability of the law in many cases to address many legal points on the ground, this does not completely excuse the judge’s incapacity. The administrative judge only exceeded the application of the law, which prevented him from reconciling the feature of stability and continuity, but rather deliberately through the exercise of jurisprudence To innovate solutions and contribute to the establishment of new legal rules, in order to repel every defect that distorts the balance of justice between litigants, and in an effort to establish and consolidate judicial security. The rule of law, and perhaps the unification of real estate jurisprudence and its role in achieving judicial security is one of the most important contents and topics of jurisprudence and judicial security as a whole, meanings that have become widely circulated in the legal field today.
