المسؤولية الجزائية للشركات التجارية عن الجرائم الاقتصادية

Abstract

إن إقرار المسؤولية الجزائية للشركات التجارية فقها وتشريعا وقضاء، دفع معظم التشريعات التي كرست هذه المسؤولية إلى تطوير مبادئ القانون الجزائي وتطوير أحكامه بما يتماشى وعقاب هذه الأشخاص عن جرائمها، وترتب عن ذلك اتساع دائرة المسؤولية الجزائية لتشمل الأشخاص المعنوية التي ترتكب الجرائم باسمها ولحسابها من طرف أعضائها وممثليها تنفيذا لسياستها الاقتصادية المسطرة من قبلها. Résumé : L’adoption de la responsabilité pénale des sociétés commerciales par la doctrine, la législation et la jurisprudence a incité la plupart des pays concernés a adapté les principes directeurs fondamentaux de leur législation de sorte a étendre la répression pénale des personnes morales à tout formes de pratiques illicites. Abstract : The establishment of criminal liability for persons in accordance with the provisions of the Code, legislation and the Code of Criminal Procedure has prompted most of the legislation that has devoted this responsibility to develop the principles of the Penal Code and to develop its provisions in line with the punishment of those persons for their crimes. This has resulted in the expansion of the scope of criminal liability to include the persons who commit crimes in their name and on their account by their members and representatives in implementation of their economic policy.
