حماية المستهلك في المجال الصيدلاني

Abstract

الملخص: يعتبر موضوع حماية المستهلك في المجال الصيدلاني من المواضيع القابلة للتجديد و التطور ، و نظرا لما لها من أهمية بالغة خاصة إذا تعلق الأمر بالمواد و المستحضرات الصيدلانية ، و التي لها ارتباط وطيد بصحة المستهلك ، و لذلك سعت التشريعات و القوانين الوضعية لضبطها و الهدف هو فرض التزامات الصيدلي و تحديد مسؤوليته سواء المدنية أو الجزائية و حتى التأديبية و لا يتأتى ذلك إلا بفرض الحماية سواء الوقائية بتنظيم الهياكل أو الردعية بتسلط السلطة القضائية في ذلك . Résumé : Le sujet de la protection du consommateur dans le domaine pharmaceutique parmi les plus importants sujets qui peut être développé et renouvelé. Elle a une grande importance surtout tous ce qui concerne les matériaux et les produits pharmaceutiques qui on un lien solide avec la santé des consommateurs ;donc les législations et les lois ont cherché de les contrôler pour l’objectif d’imposer des engagements et la détermination de responsabilité par le pharmacien quelque soit civil ,pénale ou même disciplinaire. Cela ne peut pas se caractériser que par l’imposition de la protection soit préventive en organisant les structures ou de dissuasion avec l’autorité de la justice en la matiére. Abstract: The consumer protection project in the pharmaceutical field is one of the renewable and developing topics ;and we remain because of their great importance; especially when it comes to materials and pharmaceuticals ; which is closely related to consumer health ;therefore legislation and man-made laws sought to control them and the goal is to impose the pharmacist’s obligations and determine his responsibility ;whether civil ;penal or even disciplinary, this can only be achieved by imposing protection whether preventive by organizing structures or deterrence ;whith the authority of the judicial authority in that.
