الضبط اإلداري ودوره في حماية البيئة

Abstract

الملخص يأتي موضوع البحث لتحديد دور الضبط الإداري البيئي في إرساء قواعد الحماية البيئية وفي ضوء ما تقدم وبلوغا لهدف هذا البحث، فإننا نعالج الموضوع في إطاره المفاهيمي البيئية والضبط الإداري البيئي كون هذا الأخير يهدف بالأساس إلى صيانة المجتمع وحفظ نظامه العام بعناصره الثلاث أمن وصحة وسكينة، ودراسة الهيئات الكفيلة بحماية البيئة سواء على المستوى المركزي أو المحلي ويأخذ تدخل الإدارة الشكل الوقائي يحرص فيه المشرع على المحافظة على معايير البيئة السليمة ومنع وقوع الضرر كما قد يأخذ الشكل العلاجي لمعالجة الوضع الراهن بعد حدوث المخالفة البيئية. Abstract : This research aims to define the role of environmental administrative control in establishing environmental protection regulations. In light of this, and in order to achieve the objective of this study, the topic is addressed within the conceptual framework of the environment and environmental administrative control, the latter primarily seeks to protect society and preserve public order through its three essential components: security, health, and tranquillity. The study also examines the bodies responsible for environmental protection, both at the central and local levels. Administrative intervention may take the form of prevention, whereby the legislator strives to maintain sound environmental standards and prevent the occurrence of harm. It may also take the form of remedial action, aiming to address the current situation following the occurrence of environmental damage.
