حماية حق الطفل في النسب في ظل التشريع الجزائري

Abstract

ملخص : إن الطفل هو كنز الأسرة و مستقبل الأمم ، و حقوقه تعتبر جزء لا يتجزأ من حقوق الإنسان ، و جاء الإعتراف بها في القانون الجزائري و أيضا بموجب إتفاقيات دولية وعلى رأسها إتفاقية حقوق الطفل لسنة 1989 ،و لعل أبرز هذه الحقوق هي حق الطفل في النسب . حتى تتجسد حماية حق الطفل في النسب على أرض الواقع لابد على الدولة الجزائرية تفعيل الأجهزة الناشطة في المجال الإنساني ، من منظمات و لجان متخصصة و إنشاء قانون خاص بالطفل لحفظ حقوقه كاملة و حمايتها من أي تجاوزات ، وصيانة كرامته الإنسانية Resumé : L'enfant est le trésor de la famille et l'avenir des nations, et ses droits font partie intégrante des droits de l'homme, et ils ont été reconnus dans le droit algérien et aussi selon les conventions internationales, en particulier la Convention relative aux droits de l'enfant de 1989, et peut-être le plus important de ces droits est le droit de l'enfant à la filiation. Pour que la protection du droit de l'enfant à la filiation se concrétise sur le terrain, l'État algérien doit activer les organes actifs dans le domaine humanitaire, y compris les organisations et comités spécialisés, et établir une loi spéciale pour les enfants afin de préserver leurs pleins droits et de les protéger de toute violation, et de préserver leur dignité humaine. Summary : The child is the treasure of the family and the future of nations, and his rights are an integral part of human rights, and they have been recognized in Algerian law and also according to international conventions, in particular the Convention on to the rights of the child of 1989, and perhaps the most important of these rights is the child's right to parentage. For the protection of the child's right to parentage to materialize on the ground, the Algerian State must activate the bodies active in the humanitarian field, including specialized organizations and committees, and establish a special law for children in order to to preserve their full rights and protect them from any violation, and to preserve their human dignity .
