Abstract

الملخص: إن وجود فكرة مبدأ حياد الإدارة العمومية في القانون الإداري من المتطلبات الأساسية على مستوى المرافق العمومية باعتبارها الأداة الرئيسية لتقديم الخدمة العمومية للمواطنين وهو مظهر من مظاهر تحقيق دولة القانون ككل المفاهيم السياسية مبدأ الحياد نسبي يتطلب الاهتمام بكل الاعتبارات التي تؤثر عليه من قريب أو من بعيد وحمايته من خلال وضع ضمانات دستورية وتشريعية. Résumé : La présence du principe de neutralité de l'administration publique dans le droit administratif est une exigence fondamentale au niveau des établissements publics, le considérant comme l'outil principal pour fournir des services publics aux citoyens. C'est un aspect de la réalisation de l'État de droit, comme d'autres concepts politiques. Le principe de neutralité est relatif et nécessite de prendre en compte toutes les considérations qui l'affectent de près ou de loin, et de le protéger par des garanties constitutionnelles et législatives. The presence of the principle of neutrality of public administration in administrative law is a fundamental requirement at the level of public facilities, considering it as the main tool for providing public services to citizens. It is an aspect of realizing the rule of law, like other political concepts. The principle of neutrality is relative and requires attention to all considerations that affect it directly or indirectly. It should be protected through the establishment of constitutional and legislative guarantees.
