المسؤولية المدنية للمنتج

Abstract

الملخص إن التطور الصناعي القائم أحدث طفرة في مجال الإنتاج، بحيث أصبح الهدف من التنافس بين المنتجين هو تحقيق الربح، وذلك بإنتاج منتجات لا ترقى إلى المقاييس القانونية دون مراعاة منهم لصحة وسلامة المستهلك الذي أصبح عرضة للضرر، ففي سبيل حماية المستهلك بعد عجز المسؤولية المدنية (العقدية والتقصيرية) القائمة على فكرة الخطأ استحدث المشرع الجزائري المسؤولية الموضوعية للمنتج، القائمة على إثبات الضرر وذلك بموجب المادة ١٤٠ مكرر من القانون المدني الجزائري، لضمان حق المتضرر من المنتجات المعيبة في التعويض.

Résumé: Le développement industriel existant a provoqué un déséquilibre dans le domaine de la production, de sorte que le but de la concurrence entre producteurs est de réaliser des profits, en fabriquant des produits qui ne respectent pas les normes légales sans tenir compte de la santé et de la sécurité du consommateur, devenu vulnérable au dommage, afin de protéger le consommateur après l'incapacité de responsabilité civile (contractuelle et négligence) fondée sur l’idée d'erreur, le législateur algérien a créé la responsabilité objective du producteur, fondée sur la preuve du dommage, conformément à Article 140 bis du Code civil algérien, pour garantir le droit de la personne lésée par des produits défectueux à réparation.

Summary: The existing industrial development has caused an imbalance in the field of production, so that the goal of competition between producers is to achieve profit, by producing products that do not live up to legal standards without taking into account the health and safety of the consumer, who has become vulnerable to damage, in order to protect the consumer after the inability of civil liability(contractual and tort) based on the idea of error, the Algerian legislator created the objective responsibility of the producer, based on proof of damage, in accordance with Article 140 bis of the Algerian Civil Code, to ensure the right of the person harmed by defective products to compensation.
