الاجراءات الخاصة في إبرام الصفقات العمومية في ضوء القانون 23-12

Abstract

الملخص: عالج القانون23-12 الإجراءات الخاصة لإبرام الصفقات العمومية من خلال تحديد حالات اللجوء إليها وضوابط تطبيقها حسب كل حالة، كما حرص المشرع على احترام مبدأ المنافسة والمبادئ العامة للصفقات العمومية من خلال أسلوب الاستشارة، مع السماح ببعض الاستثناءات التي تفرضها طبيعة بعض الحالات، ولضمان حماية المال العام والوقاية من الفساد ومكافحته، أخضع هذه الإجراءات للرقابة المالية تكريسا للشفافية وترشيد النفقات العمومية. Abstract: Law No. 23-12 addressed the special procedures for the award of public contracts by defining the cases in which they may be used and establishing the rules governing their application according to each specific situation. The legislator also sought to uphold the principle of competition and the general principles governing public procurement through the consultation procedure, while allowing certain exceptions necessitated by the nature of circumstances. To ensure the protection of public funds and to prevent and combat corruption, these procedures are subject to financial control, thereby promoting transparency and rationalizing public expenditure. Résumé : La loi n° 23-12 a encadré les procédures spéciales de passation des marchés publics en définissant les cas de recours à celles-ci et les modalités de leur application selon chaque situation. Le législateur a également veillé au respect du principe de concurrence ainsi que des principes généraux régissant les marchés publics à travers la procédure de consultation, tout en autorisant certaines exceptions imposées par la nature de cas particuliers. Afin d’assurer la protection des deniers publics et de prévenir et lutter contre la corruption, ces procédures sont soumises au contrôle financier, consacrant ainsi la transparence et la rationalisation des dépenses publiques.
