تعديل الدستور في الدساتير الجزائرية

Abstract

ملخّص: تُعتبر الدّساتير نتاج جهدٍ بشري قابل للتّطوير والتّحسين، وتختلف إجراءات تعديل هذه الوثائق حسب درجة جمودها، كما تتباين أسباب اللّجوء إلى المراجعة الدّستورية بين رغبةٍ في مسايرة قوانين التّطوّر، أو سدّ النّقائص التّشريعيّة، أو تحقيق مقاصد أخرى غرضها إحداث إصلاحات سياسية، أو تحقيق مآرب شخصيّة. وقد أثبتت التّعديلات الدّستوريّة الّتي قام بها المؤسّس الدّستوري الجزائري فعاليتها –ولو نسبيّاً- في مواجهة أزمات عويصة، حتّى أطلق عليها وصف "دساتير الأزمات". وعرفت الجزائر منذ استقلالها أربعة دساتير خلال الحقبتين الإشتراكيّة واللبرالية في كلٍّ من سنوات 1963، 1976، 1989، وأخيراً 1996، البعض منها طرأت عليها تعديلات جوهريّة وأحياناً ثانوية، ومقابل ذلك افتقدت الجزائر للشّرعيّة الدّستوريّة في مراحل من تاريخها، واعتمدت لسدّ ذلك على نصوصٍ ذات طابعٍ دستوري موضوعيّاً، تفتقر لأدنى مقوّمات الشّرعيّة الدّستوريّة من النّاحيّة الشّكليّة، ومع ذلك أثبتت هذه النّصوص نجاعتها في تسيير المراحل الإنتقالية. Résumé : Les constitutions sont considérées comme des efforts humains évolutifs et améliorables, ses procédures de révision varient selon sa rigidité. Suivre les lois de l'évolution, remplir les lacunes législatives, atteindre d'autres objectifs en vue de faire des réformes politiques, ou bien réaliser des objectifs personnels, Sont toutes des raisons pour lesquelles le chemin de la révision constitutionnelle est pris. Les amendements constitutionnels dont il a adopté le constituant algérien, ont fait preuve de son efficacité –même si relativement- vis-à-vis les profondes crises, jusqu'à ce qu'ils ont été appelés "constitutions de crise". L'Algérie a connu quatre (4) constitutions depuis son indépendance pendant la période libérale et socialiste et précisément dans les années 1963, 1976, 1989, et enfin l'année 1996. Parmi lesquelles, certains ont été touchées par des amendements, parfoissubstantielleset d'autres moment secondaires, et en revanche, la légitimité constitutionnelle a été manquée en Algérie pendant une toute longue durée de son histoire, ce qu'elle l'a mené d'adopter des textes - à caractère constitutionnelle dans le fond, manquant le minimum de la légitimité dans la forme – afin de remplir le vide constitutionnelle, néanmoins ces textes ontprouvéleurefficacitédans la gestion des périodestransitoires

Abstract: Constitutions are regarded as the result of an evolving and improvable human effort, and the revision procedures of these documents vary according to the degree of their rigidity. The reasons behind resorting to a constitution revision are diverse such as: keeping pace with the evolutionary laws, filling legislative gaps, achieving other goals which aim at making political reform or attaining personal targets. The constitutional amendments adopted by Algerian lawmakers proved to be effecient – though to a relative extent- in confronting hard crises. The reason why they are called "crises constitutions". Algeria issued four (4) constitutions since its independence during the liberal and socialist period in 1963, 1976, 1989 and 1996. Some of which witnessed paramount as well as secondary alterations. Consequently, the constitutional ligitimacy has been lost in some parts of the Algerian history resulting in the adoption of constitution related texts lacking the minimum formal legitimacy to fill such a constitutional gap. However, these texts proved to be effective in the management of the transitional period.
