الحقوق المالية والمعنوية للمؤلف

Abstract

الملخص: يعتبر حق المؤلف من الحقوق التي تمّ تقريرها والاعتراف بها في وقت حديث نسبيا وهي ما اصطلح عليها بالملكية الأدبية والفنية ترد هذه الحقوق على أشياء معنوية غير محسوسة من نتاج الفكر، وتمنح للمؤلف حقين حق معنوي يتمثل في نسبة انتاجه الفكري إليه وحق مالي يتمثل في استغلال هذا الانتاج أي الاستفادة منه ماديا، ونظرا لأهميتها على المستوى الداخلي باعتبارها حقوق تحمي المبدع من أي اعتداء يلحق مصنفاته عمد المشرع الجزائري الإحاطة بكل الجوانب القانونية المتعلقة بهذا المجال وذلك بسنه للقانون 03-05 المتعلق بـــــ ح.م.و.ح.م. Résumé : Le droit d’auteur est l’un des droits qui on été reconnus à une époque relativement récente, c’est ce qu’on a appelé la propriété littéraire et artistique. Ces droits renvoient à principes intangibles qui sont le produit de l’esprit . L’auteur à deux droits, un droit moral représenté en lui attribuant sa production c’est-à-dire en bénéficier financièrement. Compte tenu de leur importance sur le plan interne comme des droits protégeant le créateur de toute atteinte qui infligerait ses œuvres . Le législateur algérien a pris connaissance de tous les aspects juridiques liés à ce domaine en promulguant la loi 03-05 relative au droits d’autre et droit connexes . Summary : Copyright is considered one of the rights that have been recognized in recent time. It is what has been termed as literary and artistic property It granted to the author moral and material benifitd. Moral rights represented by the percentage of his intellectual productions and material rights from their financial returns. Copyrights has very big importance as rights to protect the authors and creators from any assaults. So, the Algerian legislator enacted the law 03-05 related to copyrights .
