Abstract

ملخّص: حق التمثيل الدبلوماسي يشمل مظهرين إيجابي وسلبي. إيجابي يتمثل في مقدرة الدولة على إرسال مبعوثين دبلوماسيين لدى الدولة الأجنبية. والسلبي يتمثل في استقبال مبعوثين دبلوماسيين للدول الأجنبية ولمباشرة هذا التمثيل لابد من أجهزة داخلية، وأجهزة خارجية، ولهذه البعثات مهام تمارسها هذه الأجهزة تحت شروط وقيود يجب عليها أن تلتزم بها. لقد منح القانون الدولي حصانات وامتيازات للمبعوث ومقر البعثة لمزاولة مهامها في ظروف جيدة لا تعيقه. مثلما هناك حق تمثيل دبلوماسي هناك إنهاء وقطع لهذه العلاقات الدبلوماسية. Résumé: Le droit à la représentation diplomatique comporte à la fois des aspects positifs et négatifs. La capacité du pays à envoyer des envoyés diplomatiques dans le pays étranger est positive. Le négatif est représenté dans l'accueil des envoyés diplomatiques dans les pays étrangers, et pour effectuer cette représentation, il doit y avoir des organes internes (le chef de l'Etat, le ministre des Affaires étrangères), et des organes externes (organisations internationales). Le droit international a accordé des immunités et des privilèges à l'envoyé et à l'état-major de la mission pour mener à bien ses tâches dans de bonnes conditions qui ne l'entravent pas. De même qu'il existe un droit à la représentation diplomatique, il y a rupture et rupture de ces relations diplomatiques.
