سلطات الإدارة في مواجهة المتعاقد معها في ضوء المستجدات القانونية في الجزائر

Abstract

الملخــــــص: أقر المرسوم الرئاسي 15- 247 المتضمن تنظيم الصفقات وتفويضات المرفق العام جملة من السلطات التي يمكن للإدارة تفعيله في مواجهة المتعاقد معها أثناء مرحلة تنفيذ العقد الإداري، ومن هذه السلطات سلطة الرقابة والإشراف وسلطة تعديل شروط العقد كسلطات وقائية وهناك سلطة توقيع جزاءات مالية وإنهاء العقد الإداري كسلطات ردعية على المتعامل المتعاقد كلها سلطات تعبر عن تفوق الإدارة من منطلق مركزها التعاقدي، إلا أن الإدارة تمارس هذه السلطات في نطاق المشروعية.

Résumé Le décret présidentiel 15-247, qui comprend la réglementation des marchés et des délégations de l'établissement public, a approuvé un ensemble de pouvoirs que l'administration peut activer face à l'entrepreneur pendant la phase d'exécution du contrat administratif. tous pouvoirs qui expriment la supériorité de l'administration quant à sa position contractuelle, mais l'administration exerce ces pouvoirs dans le cadre de la légalité.

Summary Presidential Decree 15-247, which includes the regulation of contracts and delegations of the public establishment, approved a set of powers that the administration can activate in front of the contractor during the execution phase of the administrative contract. all powers which express the superiority of the administration as to its contractual position, but the administration exercises these powers within the framework of legality.
