الجرائم المتعلقة بالأسعار في القانون الجزائري

Abstract

يعتبر السعر أحد أهم المحددات الأساسية للعبة التنافسية في السوق،لهذا فقد جرم المشرع الجزائري أي شكل من أشكال الممارسات التي قد تمس بنظام الأسعار، وذلك من خلال مجموعة من النصوص القانونية أبرزها: الأمر03-03 المتعلق بالمنافسة المعدل والمتمم،و القانون 04-02 المحدد للقواعد المطبقة على الممارسات التجارية المعدل والمتمم، وهذا بهدف الحفاظ على استقرار السوق، وحماية مصالح الفاعلين فيه من أعوان اقتصاديين ومستهلكين، وكذا تحقيق التوازن بينهم. Résumé: Le prix est l’un déterminants les plus importants du jeu concurrentiel sur le marché, c’est pourquoi le législateur Algérien a criminalisé toute forme des pratiques affectant le système des prix, à travers un ensemble des textes juridiques ,les plus importants d’entre eux est: l’ordonnance 03-03 relatif à la concurrence modifié et complété, et la loi 04-02 fixant les règles applicables aux pratiques commerciales modifiée et complétée, il s’agit de maintenir la stabilité du marché ,et de protéger les intérêts de ses acteurs, sois les agents économiques ou les consommateurs, et parvenir à un équilibre entre les deux. Abstract : Price is one of the most important determinants of the competitive game in the market that is why the Algerian legeislator has criminalized any form of practices that might affect the price system through a set of legal texts,most important is :the order 03-03 related to competition amended and complemented, and Law 04-02 fixed the rules applicable to comercial practices in order to maintain the stability of the market, and protect the interests of its actors, economic agents and consumers,and achieve a balance between them.
