طرق إبرام الصفقات العمومية في ضوء قانون 23-12

Abstract

ملخص المذكرة : خلاصة القول أن أحكام القانون 23 – 12 ، المحدد للقواعد العامة لصفقات العمومية جعلت طلب العوض قاعدة عامة لإبرام الصفقات العمومية و هو يلزم المصلحة المتعاقدة باختيار المتعامل المتعاقد الذي يقدم أحسن عرض من حيث المزايا الاقتصادية ، مع احترام المبادئ التي نصت عليها المادة 05 منه ، اذ فسح المجال للمصلحة المتعاقدة باختيار النمط المناسب لها حسب ظروف كل عملية تعاقدية و ذلك بالنص على أشكال طلب العروض و هي طلب العروض المفتوح ، طلب العروض مع اشتراط قدرات دنيا ، طلب العروض المحدود ،المسابقة ، و هذا بإتباع إجراءات معينة أثناء الابرام . كما اعتمد التفاوض بشكليه التفاوض المباشر ، و التفاوض بعد الاستشارة كاستثناء لابرام الصفقات العمومية ، و هي حالات مذكورة على سبيل الحصر في المواد 41 و 42 من قانون السالف الذكر . Memorandum Summary: In summary, the provisions of Law 23-12, which sets the general rules for public procurement, make the request for compensation a general rule for concluding public procurement contracts. It obliges the contracting authority to select the contracting operator that offers the best offer in terms of economic advantages, while respecting the principles stipulated in Article 5 thereof. It allows the contracting authority to choose the appropriate method according to the circumstances of each contracting transaction by stipulating the forms of the request for proposals, namely open requests for proposals, requests for proposals with minimum capacity requirements, limited requests for proposals, and competitions. This is done by following specific procedures during the conclusion. It also adopts the two forms of negotiation: direct negotiation and negotiation after consultation, as an exception for concluding public procurement contracts. These cases are mentioned exclusively in Articles 41 and 42 of the aforementioned law.
