Abstract

الملخص تعتبر مسؤولية الادارة على اساس المساواة امام الأعباء العامة اساس استثنائي يندرج ضمن اسس المسؤولية الادارية، كرست معظم النصوص القانونية هذا الأساس كمنطلق لمساءلة الدولة و نشاطها . تنشأ المسؤوليةالادارية على اساس المساواة امام الأعباء العامة دون خطأ و لا يثار فيها فكرة الخطر ، انطلاقا من تحليل احكام مجلس الدولة الفرنسي يمكن ان نجعله اساسا لجميع فروض المسؤولية الموضوعية. English summary: The responsibility of the administration on the basis of equality before the public burdens is considered an exceptional basis that falls within the foundations of administrative responsibility without error. Most of the legal texts have established this basis as a starting point for the accountability of the state and its activities. Administrative responsibility arises on the basis of equality before public burdens without error and the idea of danger is not raised in it. From the analysis of the provisions of the French Council of State, we can make it a basis for all the assumptions of objective responsibility. Résume La responsabilité de l'administration sur la base de l'égalité devant les charges publiques est considérée comme une base exceptionnelle qui relève des fondements de la responsabilité administrative sans erreur. La plupart des textes juridiques ont établi cette base comme point de départ de la responsabilité de l'État et de ses activités. La responsabilité administrative naît sur la base de l'égalité devant les charges publiques sans erreur et la notion de danger n'y est pas évoquée. De l'analyse des dispositions du Conseil d'État français, nous pouvons en faire une base pour toutes les hypothèses de responsabilité objective.
