Abstract

الملخص : تخضع الخدمة المصرفية بين البنك والعميل لمبادئ أساسية في النشاط المصرفي والتي تتفرع عنها التزامات مهنية بنكية عمل القانون والقضاء على تكريسها ،من أجل ضبط العمليات المصرفية تجنبا لمخاطرها و والتصدي للجريمة المنظمة،و قد فرض المشرع الجزائري التزامات هامة على عاتق البنك عبر العديد من الأحكام القانونية التي من شأنها حماية مصالح العميل بالدرجة الأولى ومصالح البنك . Resumé: La transaction entre la banque et le client est soumise a des règles de principes dans l activité bancaire qui dégage des obligations professionnelles bancaires que la loi et la jurisprudence ont consacrés afin de contrôler les opérations bancaires , éviter les risques dans ces opérations et lutter la crime organisée, le législateur algérien a édicté des obligations bancaires a travers de nombreux textes juridiques au vue de la protection des intérêts des clients au premier place et ceux de la banque. Abstract: The banking transaction between bank and client submits to basic principales in banking field that brunch off professional banking obligations which have been enacted by both law and judiciary inorder to adjust the banking operations,to evoid risks in these operations and to stand up against organized crime, the Algerian legislator has enacted banking obligations through many judicial provisions inorder to protect client s interests in the first place further more protecting bank interests.
