Abstract

ملخص: أصبحت عقوبة العمل للنفع العام تعد من أهم بدائل العقوبات التي أوجدتها السياسة العقابية الحديثة حيث عملت معظم التشريعات إلى تبنيها ،وذلك غاية في إعادة إدماج المحكوم عليه ،وكذا من أجل تفعيل المنظومة القانونية لإدراجها ضمن نصوصها القانونية.وبهذا يمكن القول أنّ نظام عقوبة العمل للنفع العام هو بديل للعقوبات السالبة للحرية قصيرة المدة بسبب آثارها السلبية. عقوبة العمل للنفع العام هو قيام المحكوم عليه بعمل نافع لصالح هيئة او مؤسسة عامة أوجمعية خاصة معترف لها أن عملها له منفعة لصالح المجتمع قانونا يقررها قاضي تطبيق العقوبات وهذا مانص به التعديل الأخير ،وهو الأمر الذي دفع بالمختصين في علم العقاب بقيامهم بالبحث عن أنظمة عقابية بديلة وأكثر فعالية ،وإفادة المجتمع والجاني معا وفقا لشروط معينة،أهما رضاء المحكوم عليه وقبوله لهذه العقوبة وهو ماأقر به مبدأ العدالة الرضائية بدلا عن العدالة التقليدية.

Summary: Community service has become one of the most important alternatives to punishments created by modern penal policy. Most legislations have adopted it, with the goal of reintegrating the convict and also to activate the legal system by including it within its legal texts. Therefore, it can be said that the community service service penalty system is an alternative to short-term custodial sentences due to their negative effects.The penalty for public benefit work is that the convict performs useful work for the benefit of a public body, institution, or private association whose work is recognized as being of benefit to society by law, as determined by the judge applying the penalties. This is what the latest amendment stipulates.This has prompted penology specialists to search for alternative, more effective penal systems that benefit both society and the offender, subject to certain conditions, most importantly the convict's consent and acceptance of the punishment. This is recognized by the principle of consensual justice, as opposed to traditional justice.
