النظام القانوني للصيرفة اإلسالمية في الجزائر

Abstract

الملخص: عرفت الجزائر سنة 2020 صدور النظام 20-02 المؤرخ في 20 رجب 1441 الموافق ل 15 مارس 2020 الذي يحدد العمليات البنكية المتعلقة بالصيرفة الاسلامية وقواعد ممارستها من طرف البنوك والمؤسسات المالية وألغى النظام 18-02 الذي لم يطبق على أرض الواقع. كما صدرت التعليمة 20-03 المؤرخة في 02 أفريل 2020 المعرفة للمنتجات المتعلقة بالصيرفة الاسلامية والمحددة للإجراءات والخصائص التقنية لتنفيذها من طرف البنوك والمؤسسات المالية. ففي هذه الدراسة تم التطرق الى مفهوم الصيرفة الاسلامية وعملياتها وتحدياتها في الواقع الجزائري من خلال النصوص والاحكام الصادرة في النظام 20-02 والتعليمة 20-03 للوقوف على مدى تدارك المشرع للنقص والتأخر التشريعي في هذا المجال. SUMMARY : In 2020, Algeria enacted Regulation No. 20-02 dated 20 Rajab 1441, corresponding to March 15, 2020, which defines banking operations related to Islamic banking and the rules for their implementation by banks and financial institutions. This regulation repealed Regulation No. 18-02, which had not been implemented in practice. Additionally, Instruction No. 20-03, dated April 2, 2020, was issued to define the products related to Islamic banking and to specify the procedures and technical characteristics for their implementation by banks and financial institutions. In this study, the concept of Islamic banking, its operations, and its challenges in the Algerian context are addressed through the texts and rulings issued in the system 20-02 and directive 20-03, in order to assess the extent to which the legislator has remedied the legislative gaps and delays in this field.
