Abstract

عنوان المذكرة: مسؤولية الدولة في التعويض عن الأضرار البيئية والكوارث الطبيعية ان دراسة المسؤولية عن الأضرار البيئية و الكوارث الطبيعية أصبحت مجال اهتمام القضاء و التشريع سواء على المستوى الوطني أو الدولي وبالرغم من التطور الحاصل لهذه المسؤولية سواءا فيما يتعلق بالأساس الذي تستند اليه أو من ناحية تحديد المسؤول عن الضرر أو بالنسبة لحدود هذه المسؤولية فانها تبقى محددة بحدود قصوى لا تتجاوزها مهما كان قدر الضرر الأمر الذي أدى الى خلق وسائل جديدة لتغطية هذه المسؤولية تمثلت في النظم الحديثة في التعويض و على رأسها التأمين بأشكاله المختلفة.

The study of civile liability for pollution damage has become an erea of interest of the judiciary and legislation,whether at the national or international level,and in spite of the evolution of this responsibility, both in terms of primarily on which,or the one hand responsible for the damage or for limits of this responsibility to determine ,it remains specific maximum limits do not exceed whatever the extent of damage,which led to the creation of new ways to cover this liability,represented in modern systems in compensation and on top of insurance in its various forms.

L'étude de la responsabilité pour dommages à l'environnement et catastrophes naturelles est devenue le domaine d'intérêt du pouvoir judiciaire et législatif, que ce soit au niveau national ou international.Malgré le développement de cette responsabilité, que ce soit au regard du fondement sur lequel elle se fonde , soit en termes de détermination du responsable du dommage, soit par rapport aux limites de cette responsabilité, elle reste limitée aux limites Un maximum qui ne le dépasse pas, quelle que soit l'étendue du dommage, qui a conduit à la création de nouveaux moyens de couverture de cette responsabilité, représentés dans les systèmes modernes d'indemnisation, auxquels s'ajoute l'assurance sous ses différentes formes.
