دور النيابة في المسائل المتعلقة بالأسرة

Abstract

ملخص: تعتبر النيابة العامة شعبة من شعب السلطة القضائية وهي النائبة عن المجتمع و الممثلة له ، و تتولي تمثيل المصالح العامة و تسهر علي حسن تطبيق القانون . فكان يقتصر دورها في تحريك الدعوة العمومية و مباشرتها أمام القضاء إلي أن تطورت و اتسعت الفكرة بعد تعديل قانون الأسرة ، و أصبح لها مركز قانوني و ذالك بالتدخل في قضايا شؤون الأسرة ، كطرف أصلي أو منظم طبقا للمادة 3 مكرر من قانون الأسرة الجزائري. Le ministère public est une division du pouvoir judiciaire de la société et représente l’intérêt public, et garantit la bonne application du droit. A un rôle limité à jouer dans le transfert du plaidoyer public vers le pouvoir judiciaire jusqu’à un développement et élargissement de l’amendement du Code de la famille qui devient un statut juridique, puis intervient dans les affaires familiales en tant qu’une partie original ou un organisme conformé à l’article 3 bis du Code algérien de la famille. Summary: The Public Prosecution is a division of the judiciary, representing the community and representing it. It was limited to its role in moving the public advocacy and direct to the judiciary until it developed and expanded the idea after the amendment of the Family Law, and became a legal status and then intervene in family affairs issues, as an original or organized party in accordance with Article 3 bis of the Algerian Family Code.
