الممارسة الرقابية لمجلس المنافسة في ظل قانون المنافسة الجزائري

Abstract

يعتبر مجلس المنافسة جهاز من أجهزة الضبط لاقتصادي على مستوى السوق الجزائرية. وعليه فقد تم استحداثه من قبل المشرع الجزائري في وقت كانت فيه الجزائر تتأهب لتبني النظام الليبيرالي، فكانت له صلاحيات استشارية وأخرى رقابية مكنته من تنظيم المعاملات التجارية إلى حد ما. ومن ضمن هذه الصلاحيات وضع حد للممارسات المقيدة للمنافسة وكذلك مراقبة التجميعات الاقتصادية ما بين المؤسسات، وبالتالي جعل المنافسة أكثر تنظيما في السوق من جهة، وبناء جسور للثقة ما بين المتعامليين الاقتصاديين من جهة أخرى.

Résume Le Conseil de la concurrence est considéré comme un régulateur de l’économie au niveau du marché algérien. En conséquence, il a été développé par le législateur algérien au moment où l'Algérie s'apprêtait à adopter le système libéral, doté de pouvoirs de consultation et de surveillance lui permettant de réglementer dans une certaine mesure les transactions commerciales. Il s’agit notamment de mettre fin aux pratiques restrictives et de contrôler les agrégations économiques interinstitutionnelles, ce qui rend la concurrence plus ordonnée sur le march

Summary ; The Competition Council shall be considered as a regulator of the economy at the level of the Algerian market. Accordingly, it was developed by the Algerian legislator at a time when Algeria was preparing to adopt the liberal system. It had consultative and supervisory powers that enabled it to regulate commercial transactions to a certain extent. These include putting an end to restrictive practices as well as controlling inter-institutional economic aggregations, thus making competition more orderly in the market, and building bridges of trust among economic operators.
