Abstract

الملخص: أسفرت الثورة الصناعية الرابعة، التي اجتاحت العالم في السنوات الأخيرة إلى بروز الذكاء الاصطناعي كأحد أبرز ملامحها بمختلف تطبيقاته وأهمها الروبوت الذكي أو الآلة الإنسان وما يميزها عن الآلات التقليدية من قدرة على التعلم والإدراك والتفكير والتعامل مع المحيط الخارجي باستقلالية، ما جعل تحديد موضعه من أشخاص القانون ضرورة حتمية خاصة وأن معالمه لم تتضح بعد بالأخص ما يتعلق منها بالمسؤولية المدنية عن الأضرار التي يتسبب يها هذا الكائن الغير بشري الجديد للأفراد والآثار القانونية المترتبة عنها.

La quatrième révolution industrielle, qui a déferlé sur le monde ces dernières années, a entraîné l’émergence de l’intelligence artificielle comme l’un de ses traits les plus marquants. Parmi ses diverses applications, le robot intelligent – ou la machine humanoïde – se distingue par des caractéristiques qui la différencient des machines traditionnelles, notamment sa capacité à apprendre, percevoir, réfléchir et interagir de manière autonome avec son environnement. Ces spécificités rendent indispensable la détermination de son statut juridique, en particulier au sein de la catégorie des personnes juridiques, d’autant plus que ses contours juridiques demeurent encore flous. Cette nécessité se pose surtout en matière de responsabilité civile pour les dommages que cette entité non humaine pourrait causer aux individus, ainsi que les conséquences juri diques qui en découlent. SUMMARY : The fourthindustrialrevolution, which has sweptacross the world in recentyears, has led to the emergence of artificial intelligence as one of itsmostprominentfeatures. Amongitsvarious applications, the intelligent robot—or humanoid machine—stands out due to itsdistinguishingcharacteristicscompared to traditional machines. Theseincludeitsability to learn, perceive, think, and interactautonomouslywithitsexternalenvironment. Suchcapabilities have rendereditimperative to determineitslegalstatus, particularlywithin the framework of legalpersons, giventhatitslegal contours remainlargelyundefined. This isespeciallycriticalwith regard to civil liability for the harmthis non-humanentitymay cause to individuals, as well as the resultinglegal implications.
