Abstract

الملخص: يرتب عقد الإيجار آثار على كلا من الطرفين المؤجّر والمستأجر، وهذا ما تناولناه في هذه الدراسة "إلتزامات طرفي عقد الإيجار المدني"، حيث تتمثل إلتزامات المؤجّر في إلتزامه بتسليم العين المؤجرة وصيانتها، كذلك ملزم بالضمان والذي يشمل إلتزامه بضمان تعرضه الشخصي وضمان تعرض الغير، وضمان العيوب الخفية، وفي حالة مخالفة المؤجّر لهذه الإلتزامات فيتعرض لجملة من الجزاءات تم التطرق إليها، أما إلتزامات المستأجر فتتجسد في إلتزامه بالانتفاع بالعين المؤجرة بحسب ما أعدت له، وإلتزامه بالمحافظة عليها، كذلك إلتزامه بدفع الأجرة، وإلتزامه برد العين المؤجرة بعد انتهاء عقد الإيجار، وإذا امتنع المستأجر عن تنفيذ إلتزاماته فهو معرّض لجزاءات تتمثل في تنفيذ العيني، الفسخ، التعويض.
