امتيازات حامل الحقيبة الدبلوماسية

Abstract

ملخّص الدّراسة يهدف هذا البحث إلى توضيح الإطار القانوني لحامل الحقيبة الدبلوماسية وللحقيبة الدبلوماسية، من خلال التعريف والشروط والامتيازات والحصانات التي تتمتّع بها الحقيبة الدبلوماسية وحاملها، كما يهدف هذا البحث إلى إظهار إساءة استخدام الحصانات والامتيازات الممنوحة للحقيبة الدبلوماسية وحاملها، والنتائج المترتبة عن هذه الإساءة، وقد استخدم في هذا البحث المنهجين الوصفي والتحليلي، ذلك لأنّهما يساعدان على وصف مشكلة البحث، وتحليل النصوص القانونية المستعملة في هذا البحث، وتوصل هذا البحث إلى مجموعة من النتائج أهمّها أنّ حامل الحقيبة الدبلوماسية، يعتبر حلقة وصل واتصال مهمّة في مجال العلاقات الدولية، لذلك يتمتّع بالعديد من الحصانات والامتيازات برفقة الحقيبة الدبلوماسية التي يحملها، وهذا ليس لفائدته الشخصية وإنّما تسهيلا لأداء مهامه، لذلك يجب عليه استعمال هذه الحصانات والامتيازات في الحدود الممنوحة له Abstract: This research aims to clarify the legal framework for the holder of the diplomatic bag and for the diplomatic bag, through the definition, conditions, privileges and immunities enjoyed by the diplomatic bag and its holder. This research also aims to show the abuse of the immunities and privileges granted to the diplomatic bag and its holder, and the results resulting from this abuse. It has been used in this research uses descriptive and analytical methods, because they help to describe the research problem and analyze the legal texts used in this research. This research reached a set of results, the most important of which is that the holder of the diplomatic bag is considered an important link and communication in the field of international relations, and therefore, enjoys many immunities and privileges accompanied by the diplomatic bag he carries, this is not for his personal benefit, but rather to facilitate the performance of his duties, so he must use these immunities and privileges within the limits granted to him
