Abstract

ملخص: يمكن اعتبار الصفقات العمومية الوسيلة المثلى لاستغلال وتسيير الأموال العامة، وقد جعلها المشرع أداة هامة في يدي السلطة العامة لإنجاز العمليات المالية وتسيير واستغلال المرافق العامة، وبما أن للصفقات العمومية علاقة مباشرة بالأموال العامة، فهي تعد بذلك مجالا معرضا لمختلف أشكال الفساد والتلاعب، لذلك أصبح من الضروري إخضاعها لآليات رقابية إدارية وقضائية فعالة.

Résumé: Les marchés publics il peut être considéré étant le meilleur moyen pour l'exploitation et la gestion des fonds publics. Le législateur en a fait un outil important, dans les mains de l'autorité publique, pour la réalisation des opérations financières, la gestion et l’exploitation des services publics. La relation directe existant entre les marchés publics et les fonds publics, expose ce domaine à diverses formes de corruption et de manipulation de sorte qu'il est devenu nécessaire de les soumettre à des mécanismes de contrôle administratifs et judiciaires efficaces. Summary: Public transactions can be considered the best means for the exploitation and management of public funds, and the legislator has made it an important tool in the hands of the public authority to complete financial operations and the management and exploitation of public utilities, and since public transactions have a direct relationship with public funds, they are therefore considered an area exposed to various forms of corruption and manipulation, so it has become necessary to subject them to effective administrative and judicial oversight mechanisms.
