سلطات المصلحة المتعاقدة اتجاه المتعامل المتعاقد في مجال الصفقات العمومية

Abstract

الملخص: أضفى المشرع الجزائري بمقتضى المرسوم الرئاسي 15/ 247 المؤرخ في 16 سبتمبر 2015 سلطات والمتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام تدابير تهدف إلى تكريس المصلحة المتعاقدة في مواجهة المتعامل المتعاقد أثناء تنفيذ الصفقة العمومية من خلال سلطنتي الرقابة والتعديل الانفرادي لشروط الصفقة، وإمكانية ممارسة سلطة توقيع الجزاءات في حالة إخلال المتعامل المتعاقد بالتزاماته. Résumé : Le législateur algérien, selon le décret présidentiel 15/247 du 16 septembre 2015, qui comprend la réglementation des marchés publics et des délégations de service publique, a ajouté des mesures visant à consacrer les autorités de l'intérêt contractant à confronter le concessionnaire lors de la mise en oeuvre du marché public à travers les pouvoirs de contrôle et de modification unilatérale des termes de la transaction, et la possibilité d'exercer le pouvoir de sanction En cas de manquement de l'operateur contractant à ses obligation. Abstract: The Algerian legislature, according to Presidential Decree 15/247 of September 16, 2015, which includes the regulation of public deals and public utility delegations, has added measures aimed at consecrating the authorities of the contracting interest in confronting the contracting dealer during the implementation of the public procurement through the powers of oversight and unilateral amendment of the terms of the deal, and the possibility of exercising the power to impose sanctions in the event that the contracting operator breaches his obligations.
