2019 المسؤولية المدنية للمهندس المعماري في التشريع الجزائري

Abstract

ملخص يكمن دور المهندس المعماري في دراسة أي مشروع بناء و الإشراف عليه، و مساعدة رب العمل إلى غاية تسلم بنائه سليما و خاليا من أي عيب، حيث تقوم مسؤوليته سواء العقدية منها أو التقصيرية حسب القواعد العامة عن الأضرار التي تحدث أثناء تنفيذ المشروع و تمس رب العمل أو الغير. و حماية أكثر لرب العمل قرر المشرع الجزائري تمديد هذه المسؤولية بعد التسلم النهائي للبناء ونظم أحكامها ضمن ما يسمى بالضمان العشري أي بقاء المهندس المعماري و المقاول ضامنين لما يحدث للبناء من تهدم كلي أو جزئي أو ظهور عيوب تهدد متانة البناء و سلامته، طيلة مدة عشر سنوات، و اعتبر باطلا كل شرط يعفي المهندس المعماري و المقاول من الضمان أو الحد منه. Résumé Le rôle de l'architecte est d'étudier et de superviser tout projet de construction et d'assister le maitre d'ouvrage jusqu'à la réception de l'ouvrage intacte et exempte de tout défaut, sa responsabilité contractuelle ou délictuelle sera engagée en cas de dommages survenus pendant la réalisation du projet et affectant le maitre d'ouvrages ou autrui. Pour protéger davantage le maitre d'ouvrage, le législateur algérien a décidé d'étendre cette responsabilité après la réception définitive de l'ouvrage dans le cadre de la garantie décennale, ou l'architecte et l'entrepreneur reste responsable de la destruction totale ou partielle du bâtiment ou des défauts qui menacent sa durabilité et sa sécurité pendant une période de dix ans. Toute condition décidée entre l'architecte et l'entrepreneur exemptant cette garantie ou la limitant, est considérée comme nulle. Summary The role of the architect is to study and supervise any construction project and to assist the client until the receipt of the work intact and free from defects, his contractual or tortious liability will be engaged in case of damage occurring during the realization of the project and affecting the master of works or others. To further protect the client, the Algerian legislator has decided to extend this responsibility after the final acceptance of the work under the decinnale guarantee, or the architect and the contractor remains responsible for the total destruction or building or defects that threaten its durability and safety for a period of ten years. Any condition decided between the architect and the contractor exempting this guarantee or limiting it, is considered null and void
