نطاق تدخل القاضي في فك الرابطة الزوجية

Abstract

الملخص: إن المشرع الجزائري قد منح لقاضي الأسرة الحق في التدخل في فك الرابطة الزوجية، وذلك بالاعتماد على النصوص القانونية والاجتهادات القضائية. حيث فصلنا في بحثنا بين دور القاضي في فك الرابطة الزوجية بإرادة الزوج المنفردة، سواء لسبب شرعي أو غير شرعي، كما يبرز دوره في الطلاق باتفاق الزوجين، وكذلك في الآثار المترتبة عن الطلاق، أو بطلب من الزوجة بتقديم طلب للقاضي، ولكن ذلك بتوفر أحد الأسباب التي نصت عليها المادة 53، بالإضافة إلى دوره في تعويض الضرر الذي يلحق بالزوجة. كما أن دوره ظهر في تقديره بدل الخلع الذي تدفعه الزوجة لزوجها بالخلع الذي يكون بإرادتها المنفردة Résumé: Le législateur algérien a donné au juge de la famille le droit de l'intervention du juge dans la dissolution de mariage, et c'est en s'appuyant sur les textes juridiques et les arrêts de la cour suprême. Nous a vous indique le rôle de juge dans la rupture de mariage par exemple: soit pour une raison légitiment ou illégale, et même que leur rôle dans les effets du divorce ou la femme soumet une demi au juge, mais c'est a condion qui il y ait des raisons proues a l'article 53, en plus de son rôle dans l'indemnisation des dommages subis par l'épouse. En plus de ca, son role apparait, en estimant l'allocation Khula que la femme verse a son mari avec la Khula qu'elle souhaite volontairement. Abstract: The Algerian legislator has been granted to a family judge to Interfere in breaking up the marital bond, based on legal text and jurisprudence.
