Abstract

الملخص حفاظا على المصلحة الخاصّة لصاحب العقار في حقّه في الإستغلال و التصرف، وازن المشرع الجزائري بين المصلحة العامة و المصلحة الخاصّة، من جهة يمنح للأشخاص الحق في الحرّية العقارية و المطالبة بحقهم في الحصول على رخصة البناء أو رخصة الهدم أو التجزئة وفق إجراءات قانونية و تنظيمية تتعلّق بتشريعات البناء و التعمير الجزائري ، و من جهة أخرى ألزم المشرع الجزائري تلك السلطات الإدارية المختصة في إصدار رخص البناء أو الهدم أو التجزئة أن تحترم الإجراءات القانونية في مجال التعمير دون التعسف في استعمال السلطة و حرمان الأفراد من حقوقهم.
