ملخص: تعد المسؤولية على أساس المخاطر في علاقة الإدارة العامة بموظفيها من الموضوعات المستحدثة التي أقرّها القضاء الإداري ، حيث تضمن للموظف الذي وقع له ضرر خاص وجسيم الحصول على تعويض طالما أن الضرر وقع له أثناء أو بمناسبة تأديته مهامه ،كما تضمن للمعاونين الذي أصابهم ضرر نتيجة تقديمهم للمعاونة الحصول على تعويض. Abstrait : La responsabilité fondée sur les risques dans la relation de l’administration publique avec ses employés est l’un des nouveaux sujets approuvés par la justice administrative , ou elle garantit au salarié qui a subi un préjudice spécial et grave d’obtenir une indemnisation tant que le préjudice lui est survenu pendant ou à l’occasion de l’exercice de ses fonctions , ainsi qu’aux assistant qui ont été lésés à la suite de leur aide à recevoir une indemnisation.
