الحق في الحصول على المعلومة في القانون الجزائري

Abstract

الملخص: يعتبر الحق في الحصول على المعلومة أحد الحقوق الأساسية للمواطنين في دول العالم، وفي الجزائر كرس هذا الحق دستوريا مما سمح للمواطنين بالوصول إلى المعلومات التي تملكها الجهات العامة مع ذلك فإن التطبيق العملي لهذا الحق يواجه تعديلات بسبب غياب قانون مفصل ينظم ممارسة هذا الحق. الحق في الحصول على المعلومة كأي حق ليس مطلق يخضع لبعض القيود، هذه القيود تحدد طبيعة المعلومات التي يمكن الوصول إليها من حيث مدى سريتها وخصوصيتها.

Abstract: The right to access information is recognized as one of the fundamental rights of citizens worldwide. In Algeria, this right has been constitutionally enshrined, granting citizens the ability to request and receive information held by public authorities. However, its practical implementation faces significant challenges due to the absence of comprehensive legislation detailing the procedures for exercising this right.

Like all rights, the right to access information is not absolute and is subject to certain restrictions. These limitations define the scope of accessible information based on criteria such as confidentiality and privacy protections.

Résumé: Le droit d'accès à l'information est reconnu comme l'un des droits fondamentaux des citoyens dans le monde. En Algérie, ce droit a été constitutionnellement consacré, permettant aux citoyens d'accéder aux informations détenues par les organismes publics. Cependant, sa mise en œuvre pratique rencontre des défis importants en l'absence d'une loi détaillée régissant son exercice.

Comme tout droit, le droit d'accès à l'information n'est pas absolu et est soumis à certaines restrictions. Ces limites déterminent la nature des informations accessibles en fonction de leur degré de confidentialité et de protection de la vie privée.
