النظام القانوني لسلطة ضبط المحروقات في الجزائر

Abstract

الملخص: تعد المحروقات ثروة وطنية يرتكز عليها الاقتصاد الوطني ، وبهدف حمايتها كان لابد من بسط الدولة لرقابتها الدائمة عليها عبر آلية جديدة وهي آلية الضبط الاقتصادي والتي خولتها الدولة لسلطة ضبط المحروقات، ومن هذا المنطلق يحاول هذا البحث أن يقدم تحليلا حول المكانة المؤسساتية والوظيفية لهذه السلطة في النظام التشريعي الجزائري باعتبارها نموذجا غير مألوف ضمن سلطات الضبط ، إذ تم الإجماع على أنها هيئة تجارية مستقلة تتمتع بصلاحيات السلطة العامة ، وبالنظر إلى إستراتيجية القطاع الذي تشرف عليه فهي لا تتمتع باستقلالية كاملة عن الجهاز التنفيذي .

Résumé : Les Hydrocarbures présentes la richesse la plus importante sur laquelle l’économie nationale est basée , et pour la protégé , il faut que l’Etat assure un contrôle permanant par un nouvel moyen de régulation économique confié à l’autorité de régulation des hydrocarbures . De ce fait cette recherche tranche sur la position institutionnelle et fonctionnelle de cette autorité au régime législatif Algérien considérée comme caractère exhaubitant parmis les autorités de régulation , quasiment classe en tant que autorité commerciale indépendante jouissant des attributions du pouvoir public. Compte tenu de la stratégie du secteur qu’elle supervise , elle ne jouit pas d’une autonomie totale du pouvoir exécutif.

Summary : Hydrocarbons are considered as an important wealth on which the national economy is based .In order to protect them , the state has to extend its permanent control through a new mechanism, which is the economic control authorized by the state for the hydrocarbons control authority. In this sense, this research attempts to provide an analysis of the situational and the functional status of this authority in the Algerian legal system as an unfamiliar model within the control authorities. It was unanimously recognized as an independent commercial body with powers of public authority .Considering the sector strategy by which it is overseen , they do not enjoy the total autonomy of the executive branch.
