الحماية القانونية للموظف في التشريع الجزائري

Abstract

ملخص: تتكون الدلوة من مجموعة مرافق عامة مكلفة بتلبية احتياجات مواطنيها المتنوعة والمتزايدة وتحقق المصلحة العامة، وهذا بعد ضمان إدارتها وتسييرها من قبل مجموعة من المواطنين العامين، وذلك بإعتبار أن الوظيفة العمومية قطاع حيوي في الدولة يحتاج لمجموع من الموظفين الذين يشتغلون في الإدارات العمومية، ولقد أحاط المشرع الجزائري الموظف العام بمجموعة من الضمانات من خلال تشريعات الوظيفة العامة، وذلك من أجل توفير ظروف ملائمة للعمل والتفرغ للقيام بأداء مهامه بما يحقق استفادة المواطنين من خدماته على أكمل وجه وحماية لحقوقه وعدم المساس بها. Résumé: L’État se compose d’un ensemble de services publics chargés de répondre aux besoins divers et croissants de ses citoyens et de servir l’intérêt général. Cette mission est assurée par la gestion et le fonctionnement de ces services par un corps de fonctionnaires, la fonction publique étant un secteur vital de l’État qui requiert un grand nombre d’agents au sein des administrations publiques. Le législateur algérien a doté les fonctionnaires d’un ensemble de garanties, inscrites dans la législation relative à la fonction publique, afin de leur garantir des conditions de travail adéquates et de leur permettre de se consacrer pleinement à l’exercice de leurs fonctions. Ceci garantit aux citoyens un accès optimal aux services publics et protègeleurs droits contre toute atteinte. Abstract: The state comprises a range of public services tasked with meeting the diverse and growing needs of its citizens and serving the public interest. This is achieved through the management and operation of these services by a group of public employees. The public service is a vital sector within the state, requiring a significant number of employees working in public administrations. The Algerian legislator has provided public employees with a set of guarantees through public service legislation, ensuring suitable working conditions and enabling them to fully dedicate themselves to their assigned duties. This guarantees that citizens benefit fully from these services and protects their rights from any infringement
