البعد البيئي للإبرام الصفقات العمومية

Abstract

ملخص المذكرة إن إدراج البعد البيئي في مختلف مراحل الصفقة العمومية أمر تسعى إليه الإدارة بالإعتماد على مجموعة من الإعتبارات والآليات التي تهدف إلى حماية البيئة من الأضرار المحتمل حدوثها أو التي قد حدثت جراء هذه الصفقات فمهمة الإدارة المتعاقدة مع المتعامل المتعهد السهر على تنفيذ هذه الاعتبارات من المرحلة الإعدادية للصفقة إلى غاية تنفيذ الصفقة. الا ان الممارسة العملية غالبا ما تثبت عدم فعاليتها كون المتعامل المتعاقد لا يراعي غالبا البنود البيئية نظرا لعدم وعيه بذلك.

Résumé :La prise en compte de la dimension environnementale dans les différentes étapes de la transaction publique est recherchée par l'administration, en fonction d’un ensemble de considérations et de mécanismes visant à protéger l'environnement des dommages potencées pouvant survenir du fait de ces opérations . La tâche de l'administration contractante avec le client contractant est d'assurer la mise en œuvre de ces considérations depuis la phase préparatoire de la page jusqu'àl’escécution de la transaction. La pratique s'avère souvent inefficace car l'entrepreneur ne tient souvent pas compte des dispositions environnementales en raison de sa méconnaissance de celle -ci. Summary:The inclusion of the environmental dimension in the various stages of the public deal is somthing that the administration seeks, depending on a set of considerations and mechanisms that aim to protect the environment from potentail damages that may have occurred as a result of these deals. The task of the contracting administration with the contracting customer is to ensure the implementation of these considerations from the preparatory stage of the deal until the implementation of the deal. Practice often proves ineffective because the contractor often does not take into account the environmental proviseons due to his lack of awareness of that.
