Abstract

ملخص رغم أن اتفاقية الأمم المتحدة لقانون البحار (اتفاقية مونتيفو باي لـ 10 ديسمبر 1982) قد منحت الدولة الساحلية كامل الصلاحيات التي تسمح لها بممارسة سلطتها على مياهها الداخلية إلا ان هذه الاتفاقية قد قيدت تلك الصلاحيات ببعض القيود في المناطق القريبة من المياه الداخلية :البحر الإقليمي و هو ما يجسده حق المرور البرئ.و لضمان سلامة الدولة الساحلية من الناحية الأمنية،الصحية و الاقتصادية فإن سيادة الدولة تمتد إلى ما وراء البحر الإقليمي بـ12 ميل بحري إلى منطقة تسمى "المنطقة المتاخمة". ésumé Bien que la Convention des Nations Unies sur le droit de la mer (Convention de Montevideo du 10 décembre 1982) ait donné à l'État côtier le pouvoir d'exercer son autorité sur ses eaux intérieures, la Convention limitait ces pouvoirs à certaines restrictions dans les zones situées à proximité des eaux intérieures: la mer territoriale et la mer Méditerranée. Qui est constitué par le droit de passage inoffensif Pour assurer la sécurité de l’État côtier du point de vue de la sécurité, de la santé et de l’économie, la souveraineté de l’État s’étend au-delà de la mer territoriale de 12 milles marins jusqu’à une zone appelée «zone adjacente».

Abstract Although the United Nations Convention on the Law of the Sea (the Montevideo Convention of 10 December 1982) granted the coastal State full powers to exercise its authority over its inland waters, the Convention limited these powers to certain restrictions in areas close to inland water: the territorial sea and Which is embodied by the right of innocent passage. To ensure the safety of the coastal State from a security, health and economic point of view, the sovereignty of the State extends beyond the territorial sea by 12 nautical miles to an area called the
