ان الضمانات السابقة والمعاصرة في توقيع الجزاء التأديبي على الموظف العام، تظهر حقيقتها عند التحقيق التأديبي والزامية استشارة لجنة الموظفين، وكذا ضمانة مواجهته بما ينسب إليه من تهم، والالتزام بالحياد وقواعد الاختصاص والشرعية في اتخاذ العقوبة المناسبة، ثم ضمانات لاحقة، تتمثل في حق الطعن ضد هذا القرار سواء أمام الجهة مصدرة القرار أو إلى رئيسها أو أمام لجان الطعن المختصة أو اللجوء إلى القضاء كوسيلة أخيرة للطعن، او ضمان محو العقوبة التأديبية او العفو عنها.
